The Supreme Court denied an emergency application from the Trump administration on Monday seeking to block California from counting ballots cast by noncitizen voters. The justices issued no noted dissents in their decision.
The administration had asked the court to intervene in efforts to keep those ballots from being counted. The court rejected the request hours after it was filed.
The decision came on a day when the Supreme Court also heard arguments in two other cases. Maxwell v. Dinis addressed whether a federal inmate can use 28 U.S.C. § 2241 to challenge the Federal Bureau of Prisons' refusal to accelerate his transfer to a halfway house or home confinement. Younge v. Fulton Judicial Circuit District Attorney's Office, Georgia concerned whether an affirmative defense may be asserted as a basis for summary judgment if not presented earlier in a pleading.
