The legal industry has a pattern. When a new technology promises efficiency, we sprint toward it without checking the terrain ahead. Right now, that technology is AI in eDiscovery, and the unpopular take is that restraint, not speed, may be the smarter strategy here.
The recent discovery struggles around AI implementation in litigation aren't bugs. They're signals. Lawyers are learning, sometimes painfully and expensively, that artificial intelligence doesn't simply slot into existing eDiscovery workflows like a software update. The tools break assumptions that have held for decades. Yet instead of pausing to understand these failures, the industry is funding more development, faster adoption, and looser governance.
This matters because eDiscovery touches everything in modern litigation. It's the foundation for document review, privilege analysis, and case strategy. Get it wrong, and you're not just wasting time or money. You're potentially compromising attorney-client privilege, creating malpractice exposure, and undermining the entire case.
The vendors have every incentive to move fast. So do law firms chasing competitive advantage. So do clients demanding cheaper and quicker discovery. The system pushes hard toward rapid deployment. What it doesn't reward is caution.
Consider what's happening behind the scenes. Teams are discovering that AI models trained on general legal documents don't reliably perform on specialized industries. Privilege detection remains inconsistent. Contextual understanding failures lead to false positives and false negatives at scale. These aren't theoretical concerns. They're operational problems that real teams are encountering in real cases right now.
The honest response would be to slow down. Build better testing protocols. Develop industry standards. Create transparency about where these tools actually work and where they don't. Establish clearer liability frameworks so firms know what they're responsible for when AI makes a mistake. That takes time. That requires coordination. That's expensive.
Instead, we're seeing a race to integrate. Some firms are implementing AI-powered eDiscovery without adequate validation. Some vendors are marketing capabilities that haven't been stress-tested across diverse document types and legal contexts. Some clients are demanding AI solutions based on hype rather than demonstrated performance.
This creates a cascading problem. Early adopters either gain real competitive advantage or become cautionary tales. But the middle ground gets crowded with firms that feel pressured to adopt before the technology has matured, before best practices exist, before the risks are fully understood. That's when mistakes become systemic.
The analogy isn't perfect, but consider how other industries have handled transformative technology. Aviation didn't rush new aircraft designs into service. Pharmaceuticals didn't skip testing phases to reach patients faster. Those industries faced real pressure to move quickly. They moved anyway, but within structured frameworks designed to catch failures before they cascaded.
Legal tech doesn't have that discipline yet. We have vendor incentives, client cost pressure, and competitive anxiety. We don't have adequate standards bodies, industry consensus on validation protocols, or clear accountability when AI-assisted eDiscovery goes wrong.
The unpopular part of this argument is the implication: some firms may need to hold back. Some clients may need to accept slower discovery timelines while the tools mature. Some matters might benefit from hybrid approaches that use AI where it's proven and conventional methods where it isn't. That feels counterintuitive in a profession obsessed with efficiency.
But efficiency of what? If AI implementation creates litigation risk, extends discovery timelines because mistakes require rework, or generates privilege issues that derail cases, then raw speed isn't efficient at all. It's just loud.
The technology isn't going anywhere. The tools will improve. Standards will develop. In five years, eDiscovery AI will be more reliable, better understood, and genuinely useful. The firms that sprint toward it today might win some early advantages. They'll also bear the cost of being beta testers for everyone else.
That's a reasonable trade sometimes. But before making it, the industry should honestly acknowledge what we don't know yet. Then decide whether speed is actually the right priority.
